Records Management - Marriage License

Requirements:

  1. Both parties need to be present to apply for a marriage license.
  2. Both parties need to present a document issued by the State or Government which verifies the date of the birth, such as a CURRENT Driver’s License, Texas Identification Card or a Passport.
  3. Social Security numbers are required for both parties (if they have ever been issued one).
  4. Fee is $67.00 in cash.
  5. There must be at least 72 hours between the date and time of issuance of a license and the time the ceremony occurs unless one applicant is on active duty in the armed forces or a waiver is granted by one of the following: a judge of a district court or a statutory county court or a county judge. (See attached list of County and District Judges who issue 72 hour waivers).
  6. The marriage license is valid for thirty (30) days from the date of purchase.
  7. A marriage license may be obtained between the hours of 8:00 a.m. and 4:45 p.m. Monday thru Friday except for County holidays.
  8. Divorce by either party must be final 30 days prior to applying for a marriage license.
  9. Age Requirements
    • 18 years or older to obtain a Marriage License without parental consent
    • 16 years old thru 17 years old - must be accompanied by a legal guardian. Parental Consent Form furnished by County Clerk's office must be filled out by legal guardian at time of obtaining a Marriage License.
    • 15 years and under - Court Order

Things to Remember:

  1. The original license will be returned to you after it is received back from the person performing the marriage ceremony and recorded in our office.
  2. A copy of the license will remain on file in the County where it was purchased.
  3. There is no law requiring a blood test.
  4. Certified copies of marriage license are $20.00 each (Downloadable Form)
  5. Plain copies of marriage license are $1.00 each (Downloadable Form)

Certificate by Credit Card:
To obtain a certified copy of a Brazoria County marriage license by Credit Card (MasterCard, Visa, American Express & Discover – no debit cards accepted), print out and complete the application form, submit payment thru www.certifiedpayments.net and specify Vitals as type of transaction, put confirmation # on form and fax to County Clerk’s Office at 979-864-1358. The application must be faxed to the County Clerks Office within 48 hours or you will be given a refund without the convenience fees. Once your form has been received the certified copy will be sent to you after the processing of the credit card (3 to 4 business days).
